The Transparency and Data Protection Council of Andalusia has issued a formal ruling requiring the Estepona Town Hall to address deficiencies on its electronic portal.

In a recent decision (PA-087/2026) prompted by a complaint from a citizen, the council has given Estepona a non-extendable deadline of one month to make public the mayor’s 2023 compensation, annual asset declarations, and complete professional background for the 2023-2027 term.

This ruling evaluates the active publicity obligations set forth by the Public Transparency Law of Andalusia and national regulations. After conducting technical checks on the municipal portal in September 2026, the council identified several shortcomings in compliance.

However, it found no violations regarding public contracts as indicated in the original complaint, confirming that the Town Hall is adhering to the law by providing direct access to both historical and current tenders through the Public Sector Contracting Platform and its contractor profile. The council also noted that information such as tax declarations and travel expenses fall outside its oversight responsibilities.

In its defense, the Estepona Town Hall claimed that asset declarations had been properly submitted to the General Secretariat prior to the mayor’s inauguration. They also argued that issues with accessing part of the corporation’s profile were due to a temporary technical glitch at the Data Processing Center, which has since been resolved.

Despite these assertions, the council has determined that the information currently available on municipal electronic platforms remains inadequate to ensure citizens’ right to access.

The Town Hall now has one calendar month from the official notification of the ruling to publish the required documents and confirm compliance with the Transparency Council. If dissatisfied with the decision, the municipality has the option to file an administrative appeal or take the matter to the administrative courts in Seville.
